Abstract
Customary law is an original law found in an area including traditions, marriage, prohibitions, and others. Starting from community conversations about the prohibition of marriage between the villages of Plosojenar, Gabel, and Carat in Ponorogo Regency, which when asked why it happened they could not explain, in this thesis the author formulates 2 main problems that will be discussed through several references and research. The formulation of these problems is First, What are the causes of the marriage ban between Plosojenar, Gabel, and Carat villages in Ponorogo Regency? Second, What are the consequences of customary law for those who violate this marriage ban? Therefore, the purpose of this research is to examine how customary law regulates the prohibition, what is its history and what consequences are obtained if the prohibition is violated. This research uses a type of research with empirical legal methods, where this research emphasizes the existing reality in order to obtain data used for research by means of interviews, observation, and documentation. This research uses primary data sources obtained directly from the community, and this research uses data analysis techniques with descriptive methods by explaining the data in a narrative manner to convey an explanation. The results of this study show that the prohibition starts from the chronicle of the land which gives rise to an assumption that when marrying between villages it will get bad luck, the consequences of this prohibition include broken relationships in the middle of the road, disharmony, and also families who get sanctions. However, it was also found that the prohibition can be circumvented under several conditions. And if examined with Law No. 1 of 1974 this marriage can be null and void because it violates the provisions of Article 8 point f.
