Abstract

The use of smartphones while driving is a significant issue with serious implications for traffic safety. The Traffic and Road Transport Law (UULLAJ) regulates the prohibitions and rules that must be followed by road users, including the use of smartphones while driving. This regulation is stipulated in Article 106, Paragraph (1) of Law No. 22 of 2009, which states that "Every person driving a motor vehicle on the road is required to drive the vehicle reasonably and with full concentration." Although there is no specific mention of a ban on smartphone use while driving, the term "concentration" implies that using a smartphone while driving greatly disrupts focus. Those who violate this can face "criminal sanctions" with a maximum imprisonment of 3 (three) months, "fines" of up to Rp750,000.00 (seven hundred fifty thousand rupiah), and also the temporary or permanent revocation of their driving license.
