Abstract

ABSTRACT
Inheritance law in Islam is an integral part of Islamic law known as Faraidh. The basic principle of Islamic inheritance law is to ensure the distribution of inheritance fairly and equitably among heirs in accordance with the provisions set out in the Qur'an and Hadith. This distribution of inheritance aims to maintain social justice and family welfare. In Islamic inheritance law, there are several main heirs such as children, parents, husband or wife, and siblings. Each heir has a certain portion that has been specifically determined in the Qur'an, which cannot be changed or challenged.

The main challenge in implementing Islamic inheritance law today is adaptation to social and economic changes. Globalization, urbanization, and changes in family structure affect the way people view and practice inheritance law. Many areas, especially in the smallest scope, namely villages with a Muslim majority, are hesitant between implementing Islamic inheritance law strictly or reforming it to adapt to the modern context. In some countries, Islamic inheritance law is integrated with civil law, which sometimes causes legal conflict and confusion among the community. Likewise in the Bancar village community where Islamic inheritance law is not a native cult in the area, there are various provisions in the Bancar village community that can be used by the community to distribute inheritance to their heirs.
