Abstract

This research discusses the application of restorative justice in criminal law by highlighting two main aspects: legal regulation and its application in the criminal justice system in Indonesia.
Restorative justice is an alternative approach in resolving criminal cases that emphasizes restoring relationships between perpetrators, victims and society and provides opportunities for perpetrators to correct their mistakes. In Indonesia, restorative justice arrangements are regulated in several regulations, including Law no. 11 of 2012 concerning the Juvenile Criminal Justice System and Government Regulation no. 65 of 2005 concerning Procedures for Implementing Restorative Justice in Children's Cases. This approach aims to reduce relapse rates and help victims recover.
However, the implementation of restorative justice in Indonesia faces a number of challenges. There are still deficiencies in understanding and consistency of implementation, as well as limited resources, training and awareness among legal practitioners. This research shows that to increase the effectiveness of restorative justice in the criminal justice system, greater support is needed from various parties, including law enforcement, correctional institutions and the community. Increased awareness of the benefits of this approach as well as improvements in the administration of justice are expected to strengthen its application in resolving general crimes in Indonesia.
