Abstract

This research analyzes the implementation of Article 27A of Law No. 1 of 2024, the second amendment to Law No. 11 of 2008 concerning Information and Electronic Transactions (ITE), in handling defamation cases on social media. The purpose of this study is to understand the application of Article 27A in addressing defamation offenses on social media and to evaluate the extent to which this provision is effective in providing legal protection for victims in the digital era. The research method used is normative, employing a statutory approach and literature review. The results of the study indicate that Article 27A of Law No. 1 of 2024 provides a more specific and clear legal foundation for law enforcement in dealing with defamation cases conducted through social media platforms. This article also upholds the principles of a constitutional state and respect for human rights, highlighting the importance of protecting victims from various forms of content that may harm their reputation and dignity. However, the implementation of this article still faces several obstacles, including technical challenges in tracing perpetrators who utilize anonymity, unequal public understanding of the relevant legal norms, and inconsistency in the enforcement standards applied by authorities. Therefore, efforts are needed to strengthen its implementation across various aspects, ranging from increasing digital literacy within society to providing training and building the capacity of law enforcement authorities. Through these measures, it is hoped that Article 27A will provide more robust protection for victims and maintain the integrity of communication in social media spaces.
