This undergraduate thesis examines the implementation of agricultural profit-sharing agreements between landowners and cultivators in Tranjang Village, Ponorogo Regency, from the perspective of civil law. This research was motivated by the fact that many agricultural profit-sharing agreements are still conducted orally and are based solely on mutual trust and customary practices within the community. Such conditions have the potential to create legal uncertainty, particularly regarding the fulfillment of the rights and obligations of the parties in the event of future disputes. Therefore, this study aims to analyze the implementation of agricultural profit-sharing agreements in Tranjang Village and to assess their conformity with the principles of civil law.

This study employs an empirical legal research approach with a sociological juridical perspective. Primary data were collected through interviews with landowners and cultivators, while secondary data were obtained from relevant legislation, books, and scholarly journals. The data were analyzed qualitatively by comparing the actual practices with the provisions of civil law, particularly those governing agreements.

The findings indicate that agricultural profit-sharing agreements in Tranjang Village are generally established through mutual consent between landowners and cultivators without written documentation. The cooperation begins with an initial agreement, followed by land cultivation by the cultivator, and concludes with the distribution of agricultural yields in accordance with the agreed terms. The proportion of profit sharing varies depending on each party's contribution, including production costs, labor, and land provision. This practice is primarily based on mutual trust, social relationships, and customary traditions that have been maintained for generations.

However, several issues remain in the implementation of these agreements, including the unequal bargaining position between landowners and cultivators and the absence of written agreements that could serve as legal evidence in the event of disputes. These conditions indicate that the implementation of such agreements has not fully reflected the principles of legal certainty, justice, and balance as stipulated under civil law.

In conclusion, although agricultural profit-sharing agreements in Tranjang Village have been generally implemented and continue to function effectively based on customary practices, they are not yet supported by strong legal safeguards. Therefore, greater legal awareness among the community is necessary, along with encouragement to formalize agreements in writing to ensure greater clarity regarding the rights and obligations of each party. Furthermore, the village government plays an important role in providing legal education and assisting the community in drafting simple written agreements to minimize the potential for disputes in the future.
