Abstract

ABSTRACT
This study discusses the urgency of implementing rehabilitation for narcotics offenders based on Law Number 35 of 2009 concerning Narcotics. The problem of narcotics abuse in Indonesia continues to increase and has negative impacts on physical health, mental conditions, and social life. In law enforcement practices, narcotics addicts and abusers are not only viewed as criminal offenders but also as victims who require treatment through medical and social rehabilitation. This study aims to analyze the implementation of legal sanctions and the effectiveness of rehabilitation for narcotics offenders.
The research method used is normative legal research with a statutory approach. The data used are secondary data obtained from legislation, journals, books, and other legal literature. Data analysis was conducted descriptively and qualitatively by examining legal provisions related to narcotics rehabilitation and their implementation in law enforcement practices in Indonesia.
The results show that rehabilitation is considered more effective than imprisonment because it focuses on the physical, mental, and social recovery of narcotics users. However, the implementation of rehabilitation still faces several obstacles, such as differences in legal interpretation, limited rehabilitation facilities, and social stigma against former narcotics users. Therefore, strengthening regulations, improving rehabilitation facilities, and increasing support from the government and society are necessary so that rehabilitation can be implemented optimally and reduce narcotics abuse cases.
