Abstract

This study aims to analyze the development of divorce cases at the Magetan Religious Court and to identify the factors contributing to divorce. Divorce is considered a last resort when the goal of marriage to establish a harmonious family can no longer be maintained. This study employs an empirical legal research method with a socio-legal approach. The research was conducted at the Magetan Religious Court in December 2025. Data were collected through interviews and document analysis, while the data were analyzed qualitatively. The results show that divorce cases at the Magetan Religious Court remain one of the most dominant types of cases. In 2024, there were 1,062 divorce decisions, consisting of 789 divorce petitions filed by wives and 273 divorce petitions filed by husbands. Meanwhile, in 2025, 995 divorce cases were decided, consisting of 733 divorce petitions filed by wives and 262 divorce petitions filed by husbands. These data indicate that divorce petitions filed by wives were more prevalent than those filed by husbands. The main factors contributing to divorce include continuous disputes and conflicts, economic factors, lack of responsibility within the household, domestic violence, as well as social factors and changes in lifestyle patterns. The high number of divorce cases reflects social dynamics within the community as well as increasing legal awareness in resolving domestic problems through the judicial system. Mediation conducted by the Magetan Religious Court is one of the efforts to preserve family unity, although it has not yet been fully effective in reducing the divorce rate
