Abstract

ABSTRACT
Visitation is one of the important rights of Correctional Assisted Citizens (WBP) to maintain family and social relationships while serving their sentence, which is recognized as part of the human rights of prisoners in the modern penitentiary system. Law Number 22 of 2022 concerning Corrections (Correctional Law) emphasizes that WBP has the right to be in contact with the outside world, including through family visits and legal advisors, while still paying attention to the security and order aspects of correctional institutions. This study aims to analyze the normative regulation of visitation rights in the Correctional Law and its implementing regulations, as well as examine the implementation of WBP visitation rights in Class I Madiun Prisons, along with supporting factors and obstacles to its implementation. This study uses normative legal research methods. Normatively, this study examines the 1945 Constitution of the Republic of Indonesia, the Correctional Law, and other related regulations with a legislative, conceptual, and historical approach to build a legal framework for visitation rights. Empirically, the research was conducted through interviews, observations, and documentation studies at the Madiun Class I Prison to describe the practice of visitation services and assess their suitability with normative provisions. The data obtained were then grouped, interpreted, and synthesized qualitatively to answer the formulation of the research problem.
The results of the study show that normatively the right to visit WBP in Class I Madiun Prison has a clear legal basis and should not be arbitrarily restricted, because it is closely related to the fulfillment of human rights and the purpose of social development and reintegration. In practice, the implementation of visitation rights has basically been carried out through administrative procedures, rules, and the provision of visit services, but there are still a number of obstacles such as limited facilities and infrastructure, workload of officers, and lack of understanding of some visitors to applicable procedures. Factors supporting implementation include the existence of more comprehensive arrangements in the Correctional Law, the commitment of some officers, and cooperation with WBP families; while inhibiting factors include limited facilities, density of visitors on certain days, and potential inconsistencies in the implementation of discipline. This study concludes that the implementation of visitation rights in Class I Madiun Prison has led to the fulfillment of the standards of the Correctional Law, but it still needs to be strengthened in terms of facilities, service quality, and supervision so that the protection of WBP visitation rights can be realized more optimally and oriented towards respect for human rights.
