Abstract
The increasing number of female workers working at night, both in the formal and
informal sectors. Economic factors, industry demands, and greater gender equality
in the workplace are driving more women to work at night. This condition, although
it provides opportunities for women to be economically independent, also opens up
the potential for greater risks, such as work accidents, physical violence, sexual
harassment, and higher health problems compared to male workers. This study uses
a normative legal approach, which aims to examine and interpret existing legal
texts to understand the content and purpose of these legal norms. The data
collection method used in this study is library research. Library research is a
method that focuses on exploring existing written materials, which can be in the
form of books, journal articles, research reports, laws and regulations, and other
documents that are relevant to the topic being studied. The legal protection that has
been regulated provides equal rights for female and male workers, including in
terms of wages, leave rights, occupational safety and health, and competency
development. Companies have an obligation to provide protection, but in reality,
there are still many companies that have not fully complied with these provisions.
In addition, although there are regulations that regulate these rights, less than
optimal implementation in the field has caused these regulations to not be fully
implemented. One of the steps needed is to conduct more intensive socialization
regarding the rights of female workers, both those related to legal, health, and
occupational safety aspects. This socialization can be carried out by government
institutions, trade unions, or women's organizations, so that female workers better
understand the rights they have and how to demand appropriate protection.
