Abstract

This thesis examines the management of dormant accounts within the banking system and the legal certainty concerning the rights and obligations of customers when an account is declared inactive by a bank. The research focuses on the mechanism for managing dormant accounts implemented by banks, starting from the determination of inactive status to the process of reactivating such accounts. In addition this thesis also examines the legal certainty for customers in regaining access to accounts that have been categorized as dormant. The method employed is normative legal research using a statutory approach and a conceptual approach. The legal materials used consist of primary legal materials in the form of banking regulations applicable in Indonesia, particularly those relating to account management and banking supervision
This study also uses secondary legal materials in the form of books, scientific journals, and research findings relevant to the issues under examination. The analysis was conducted normatively by examining the conformity between the applicable legal provisions and the practice of dormant account management implemented by banks. The results of the study indicate that the management of dormant accounts is carried out through several administrative stages. The process begins with monitoring customer account activity followed by the identification of accounts that show no activity within a certain period, after which administrative marking is carried out in the bank's internal system, culminating in the recording of dormant status in the core banking system. The determination of such status is associated with the implementation of the prudential principle and efforts to control the bank's operational risks in order to prevent the potential misuse of inactive accounts
The regulation of dormant accounts in banking regulations remains general in nature, allowing each bank discretion to establish its own internal procedures. This condition results in differences in determining dormant status as well as in the procedures for reactivating dormant accounts among banks. The determination of dormant status does not eliminate the customer's ownership rights over the funds deposited in the account or the customer's right to reactivate the account. Legal certainty for customers is highly influenced by the clarity of the procedures established by the bank and the consistency of their implementation. In addition a balance is required between the bank's authority to control operational risks and the protection of customers' rights within the legal relationship between banks and customers
