Premeditated murder is an act that is very detrimental to many parties, including the murder victim himself. In its implementation, murder can harm many parties, including the murder victim himself. perpetrator. In Indonesia itself, premeditated murder is often in the spotlight, so usually the sentence imposed by the convict is the death penalty or life imprisonment. Of the many cases of premeditated murder in Indonesia, one of them is a murder committed by law enforcement officers, namely the murder case of Brigadier J, which was carried out by his superior, namely Ferdy Sambo and his aide. This research aims to analyze the judge's considerations in imposing the death penalty on the convict Ferdy Sambo. The research method used is a normative research method or analysis of the contents of court decision documents related to the case. This research highlights the factors considered by judges in determining the death penalty, such as legal objections, community interests, and mitigation considerations. The results of this analysis provide insight into what factors influence judges' decisions in death penalty cases and their implications for justice and human rights. It is hoped that this research can contribute to further understanding of the judicial process and law enforcement related to the death penalty in Indonesia.
