Abstract

Intellectual Property Rights (IPR) Protection for Brands for Micro, Small, and Medium Enterprises (MSMEs) in the culinary sector is an important aspect in maintaining business sustainability and preventing violations such as imitation and piracy. In this context, this study aims to analyze the effectiveness of the current IPR dispute resolution mechanism and the level of legal awareness of culinary MSME actors regarding the importance of IPR registration. In Indonesia, although there are several regulations governing IPR protection, such as the Law on Copyright, Patents, and Trademarks, the practice of imitation of culinary products still often occurs. This is exacerbated by the low awareness and understanding of MSME actors regarding IPR registration procedures and the legal protection they can obtain. This study uses a normative legal method with a literature study approach and analysis of related laws and regulations. The results of the study show that the IPR dispute resolution mechanism in Indonesia still faces several obstacles, such as a long process and high costs, making it less effective for MSMEs. In addition, the level of legal awareness of culinary MSMEs regarding the importance of IPR registration is still low, due to the lack of education and socialization from the government and the perception that the IPR registration process is time-consuming and costly. This study suggests that there be a simplification of IPR registration procedures and an increase in educational programs that are more focused on culinary MSMEs to improve IPR protection. By increasing the awareness of culinary MSMEs regarding the importance of IPR registration and improving the effectiveness of dispute resolution mechanisms, it is hoped that innovation in the culinary industry can be protected and healthy business competition can be created. This study contributes to the development of government policies in protecting intellectual property rights, especially in the culinary MSME sector.
