Abstract

The increasing number of marriage dispensation applications at the Religious Court of Ponorogo following the enactment of Law Number 16 of 2019 raises critical legal and social concerns. The law raises the minimum marriage age for both men and women to 19 years, aiming to reduce the prevalence of child marriage. However, the continued allowance for dispensations has led to a significant rise in such applications. This study aims to analyze the implementation of marriage dispensation policy changes in the Religious Court of Ponorogo and to identify the factors contributing to the high number of applications. Employing a juridical-empirical approach, data were collected through in-depth interviews, direct observation, and document analysis. The results reveal that dispensation applications are largely driven by premarital pregnancy, cultural and social pressure, low education levels, and inadequate parental supervision. Although the Supreme Court has issued Regulation (PERMA) No. 5 of 2019 to guide the adjudication of such applications, its implementation at the local level has not been fully effective in curbing the growing number of requests. This study concludes that the effectiveness of the marriage dispensation policy is not solely dependent on legal instruments, but also requires integrated efforts involving legal enforcement, public education, and the empowerment of social and religious institutions to prevent early marriages.
