TINJAUAN HUKUM PENGESAHAN KEPENGURUSAN TUNGGAL PERSAUDARAAN SETIA HATI TERATE (STUDI KASUS KEPUTUSAN MENTERI HUKUM DAN HAM NOMOR AHU-0005248.AH.01.07 TAHUN 2025)

This study aims to analyze the conformity of the Decree of the Minister of Law and Human Rights Number AHU-0005248.AH.01.07 of 2025 with the provisions of Law Number 17 of 2013 concerning Mass Organizations (as amended by Law Number 16 of 2017) and its implementing regulations regarding the ratification of a single leadership board for *Persaudaraan Setia Hati Terate* (PSHT) amidst ongoing leadership dualism. A normative-juridical approach is employed, simultaneously integrating Hans Kelsen’s Pure Theory of Law (*Stufenbau der Rechtsordnung*) and Lawrence M. Friedman’s Legal System Theory (structure, substance, and legal culture).
The research findings indicate that the 2025 Ministerial Decree meets formal validity requirements under Kelsen’s theory, as it was issued based on Notarial Deed Number 02 dated July 11, 2025, revoked the previous Decree (Number AHU-0001626.AH.01.07 of 2022), and served as a follow-up to Supreme Court Decisions Number 68/PK/TUN/2022 and Number 50 PK/Pdt.Sus-HKI/2022. From Friedman’s perspective, the decision has proven effective regarding legal structure (the Ministry of Law and Human Rights) and legal substance (the Mass Organizations Law in conjunction with Government Regulation No. 58 of 2016); however, weaknesses persist in the legal culture dimension among PSHT members, some of whom maintain emotional loyalty to the leadership board whose decree was revoked.
This study addresses a research gap by simultaneously combining these two theories to analyze the ratification of a single leadership board following a period of dualism. The study concludes that Ministerial Decree 2025 has provided legal certainty for PSHT as the oldest and largest *pencak silat* mass organization in Indonesia, although intensive dissemination is required to strengthen public acceptance.
