Abstract
This study aims to analyze the legal risks faced by consumers when purchasing cosmetics through the TikTok platform and to examine the forms of legal protection available to them. This study employs a normative legal research method with a descriptive-analytical approach based on the Consumer Protection Law, the Electronic Information and Transactions Law, Government Regulation Number 80 of 2019, Minister of Trade Regulation Number 31 of 2023, and BPOM Regulation Number 18 of 2024. The results show that consumers still face various risks, including the circulation of illegal cosmetics, misleading promotions or overclaims, information asymmetry, and difficulties in obtaining compensation. Legal protection is available through BPOM supervision, the obligation of business actors to provide accurate information, and complaint mechanisms through TikTok Shop, the Consumer Dispute Settlement Agency (BPSK), the Indonesian Consumer Foundation and Self-Regulatory Consumer Protection Institutions (LPKSM), as well as litigation. However, its implementation remains suboptimal due to limited supervision, the absence of real-time integration with the BPOM verification system, and the unclear legal responsibilities of influencers and platforms. This study concludes that consumer protection regulations are normatively adequate but have not fully accommodated the characteristics of social commerce. Therefore, stronger regulations are needed concerning the responsibilities of platforms and influencers, integration of the BPOM verification system, development of electronic dispute resolution mechanisms, and improvement of consumer education to ensure effective legal protection for cosmetic consumers on TikTok.
