Abstract

Referring to Law No. 12 of 1995 concerning the Correctional System, it is
necessary to prepare the rules, personnel, management and prison facilities. Among
these are limited detention facilities. On the other hand, the number of crimes has
increased, resulting in an increase in the number of prisoners and detainees. As a
result, prisons experienced overcapacity. The research method used is Normative
Juridical Analysis Normative juridical analysis involves the collection and
evaluation of legal materials. The collection of primary, secondary and tertiary legal
materials is obtained by searching the literature, either through study in the library
or accessing via the internet. Data processing in this normative research is carried
out in the stages of selection and classification of legal materials. The results of this
research explain the factors and actions that need to be taken to overcome prison
overcapacity, because the number of prisoners is greater than the available places,
causing a surplus which is a crisis situation due to prison overcrowding. The cause
of excess capacity is not only due to the lack of number of correctional institutions
or increasing crime trends, but also because the content of criminal law is
considered less comprehensive in terms of coordination between law enforcement
agencies and correctional institutions. Management of the excess capacity system
must be carried out systematically through the content of alternative prison criminal
laws, legal structures in strengthening institutional structures and legal culture
which are incorporated into law enforcement discipline.
