Abstract

The alleged corruption case in the procurement of crude oil and refined products at PT. Pertamina (Persero) for the 2018-2023 period shows that irregularities occur not only due to weak formal regulations, but also through informal interactions and negotiations between actors in the tender procurement process. This study aims to analyze how these corrupt practices occur through structural relations, negotiation processes, and negotiation contexts using the Negotiated Order Theory perspective. This study uses a qualitative approach with a netnography method, sourced from credible media reports such as Kompas TV, Detik.Com, Tempo.co, and other credible media. The results show that the organizational structure, standard operating procedures, and tender procurement mechanisms are not implemented neutrally. Instead, they are renegotiated by strategic actors through informal communication, procurement information leaks, and price adjustments and alpha prices. These negotiations create a new work order that conditions the tender winners, namely BP Singapore and Sinochem International Oil, and causes state financial losses. This study concludes that corrupt practices in state-owned enterprises are the result of the construction of an organizational structure formed through repeated negotiation processes.
